Several individuals are still facing trail in the United States because of
allegations regarding their company’s illegal business in the U.S. online casino
gambling and betting industry. BetonSports is no longer in operation and two of
the senior level founders and CEOs of the company are held in custody in the
U.S. awaiting trial. Both David Carruthers and Gary Kaplan, both facing many
charges not the least of which is racketeering, had hopes that they could use
the protection of the 1995 GATS treaty to secure their release or at least
lessen their sentence – those hopes have now been dashed thanks to a ruling in
U.S. courts.
BetonSports was investigated by the U.S. government for months before shutting
down the company several years ago and arresting the founder and CEO. The
company had a litany of charges against it and not long after BetonSports gained
international attention in the online casino gambling industry the U.S.
announced that BetonSports was not the only gambling company facing
investigation. The U.S. implemented the controversial 2006 UIGEA which
effectively put an end to foreign online casino gambling companies legally
accessing the U.S. market.
More than two years since the arrest of the one of the BetonSports founders, the
case is still awaiting trial and the arrested individuals remain in jail or on
house arrest. They had hopes that the GATS treaty (General Agreement of Trade in
Services) would provide some protection, but the U.S. court ruling succinctly
surmised that the GATS treaty did not cover individual and private rights –
meaning both individuals are in the same boat they were in last month…little
hope for an acquittal (the prosecution has ample evidence against the online
casino betting company) and the continued wait for a trial. |
