Inside the Court Room
The online caisno gambling industry is abuzz with the news that the Appeals
hearing for the domain name seizure case went quite smoothly. The judges in the
case are taking some time before announcing their ruling, which was entirely
expected by most in the court room. The actually hearing itself apparently bodes
well for the online casinos in question according to many of those present in
the courtroom. Judge Wingate’s ruling has sparked controversy all over the world
and most definitely outside of the online gambling industry because of the
implications in his ruling – that Kentucky courts have the right to exert an
amount of control over internet companies in foreign countries.
The internet is full of questionable information and companies that are
operating a business that is illegal somewhere in the world – it doesn’t even
have to be a controversial industry like online casino gambling – even the
distribution of information is illegal in certain countries. But at the same
time, although many businesses are illegal somewhere, Net Neutrality and an
as-yet untested agreement between the counties has been the free operation of
the internet. Individual countries like China, Myanmar, and other nations have
chosen to block sites at an IP level, but the Kentucky situation will be a first
in the age of the Internet if the Kentucky state government is authorized to
confiscate foreign online casino domain names because of a violation of local
legislation.
The fifty minute hearing in the Appeals Court indicated that three judges had
read all of the support and opposition arguments and came prepared with
questions and thoughts on the process that undoubtedly indicate that the judges
understand the weight of the decision facing them. There is no indication yet
which way the judges were leaning, but certainly many in the online casino
gambling industry are hopeful of a positive outcome. |
