Although many supporters assumed that the bill would bypass the federal restrictions on domestic and offshore online casinos because it only dealt with poker gambling within the state, the U.S. government expressed concerns that the planned legislation was still in violation of the UIGEA and the Wire Act.

Naturally there are still opponents who aren’t interested in seeing the California government even study the potential of online casino poker in the state. The specifics of the bill as they are right now call on the state agencies to develop a structure and framework of legislation that would support legalizing internet poker if an appropriate bill were passed. The intention is to iron out the details and ensure that legalizing and regulating the industry is even a possibility rather than outright vetoing the idea because it has run into a few (albeit major) hurdles.

Wording within the proposal is specifically written to emphasize that the passage of AB 2026 will not legalize online casino poker gambling in the state but rather issue a study of the possibility and feasibility of legalizing the game through the internet. The bill reads:

"The enactment of this act does not authorize the play of Internet poker. In enacting this act, it is merely the intent of the Legislature to have the appropriate state agencies develop a suggested structure, potential regulatory guidelines, and estimate on the amount of revenues to the State of California that may be generated by the play of Internet poker for possible consideration in the future."

This section of the proposed bill is really important to emphasize because it shuts down the majority of the opposition. Opposing interest groups in California have no real ground to stand on considering it is only a study at this point. Plus groups like the Poker Player’s Alliance and other organizations in favor of legalizing a mobilizing supporters to voice their support for any bills that would further their causes related to internet poker and online casino gambling.
