The Specifics Are Clear

The Poker Players Alliance has made headlines over the past year as the internets group not only gained more than a million members, but the PPA has also been involved in nearly every minute piece of legislation that will potentially affect the viability of legal online casino poker gambling in the United States. The PPA has notably backed legislation from Representative Barney Frank, which would have licensed and regulated online casinos accessing the U.S. gambling market. Other legislation is similarly designed to provide carve-outs for poker gambling, which arguably should not be considered a game of chance. The newest news from the PPA is the announcement that the organization will not back HR 6663 – a new bill from Representative Pete Session.

The new bill on the table would not make a whole lot of headway in clarifying the online casino gambling debate in the United States according to the Chairman of the PPA, Alphonse D’Amato. D’Amato has strongly asserted that the legislation in the United States is already very clear on the legality of online casino poker gambling – now the organization just has to convince others that internet poker is not covered by the UIGEA.

D’Amato specifically explained the reason that the PPA will not back this latest bill. He elaborates, “The PPA remains concerned with the implication HR 6663 asserts that the UIGEA has made internet poker an unlawful activity that needs special protection. Previous federal case law (re: MasterCard 2002) has made it clear that existing federal criminal law (WIRE Act of 1961) applies only to internet sports wagering and not to internet poker. Further, the UIGEA itself states, ‘No provision of this subchapter should be construed as altering, limiting or extending any federal or state law.’ Thus HR 6663 only confuses a clear judicial standing on this matter.”

There is only a slim likelihood that Session’s newest bill will make it through the House considering popular bills regarding the licensing and regulation of the online casino gambling industry have thus far failed to pass. No outcome and further discussion is expected until the House and Senate are back in session next month.
