Why so Hesitant?
The fact that so many European countries are willing to brazenly defy EU trade
policies in favor of exclusivity and protectionist legislation leaves many
asking why the countries are willing to face heavy fines and consequences? Well
like most questionable behaviors, a lot of the answer comes down to greed and
money. The fact of the matter is that online casino gambling is extremely
lucrative, and only more so for the governments that are able to exclusively
cash in on a large percentage of the gambling revenues. At the current count
there are ten European countries operating exclusive online gambling monopolies
despite pressure from the European Commission to comply with EU policies
regading the movement of free trade and services between EU member-states.
On the one hand, the European Commission has the ability to investigate any
infractions in EU countries that may be violating the EU trade agreements, but
on the other hand, the Commission does not have the power of enforcement. Right
now the Commission has been in talks and negotiations with all of the ten
violating EU countries: Switzerland, Greece, Holland, France, Germany, . But for
most of the countries, the talks and negotiations has had little effect on the
actually online casinos gambling policy. In fact several govenments are
operating and responding to the Commission with the full knowledge that the most
the Commission can do is recommend that the country be brought before the
European Court of Justice.
This is where several cases are heading – particularly Germany, because the
countries refuse to comply with the Commission’s requested online casinos
gambling policy and Germany has in fact purposely tightened the country’s
restrictive state gambling policies. At this point, the Commission is beginning
to issue final warnings to the countries in violation, and the next step is to
bring the online gambling companies before the European Court of Justice.
Countries facing the ECJ can expect large fines and the forced opening of the
market if the courts find the monopolistic policy does in fact EU trade
agreements. |
