What many in the state assert at this point is that the federal regulation specifically concerns foreign online casinos and further only applies to gambling transactions occurring with financial institutions operating in other states – what this means is that individual states would apparently have the right to independently decide whether or not they want to license and regulate online gambling and poker within the State.

This is actually debatable at this point, but legislators in California, and interest groups pushing for the legalization of online casinos poker gambling in the state assert that state-run internet poker will not run into problems with the federal prohibitive legislation.
