DoJ Won't Touch the Horserace Industry
The assertion that horserace betting online is legal in the United States is not
actually completely factual. Though the Department of Justice (DoJ) has yet to
prosecute any of the online casino horserace betting companies, the U.S. laws
are actually quite murky where horserace betting is concerned. Last year’s
online casinos ban, the Unlawful Internet Gambling Enforcement Act (UIEGA), was
specific in the regulations that affect only offshore online casino companies
and gambling activities – land-based online horserace betting received no
clarifications within the UIEGA.
Though some media outlets are alluding to possible litigation between the online
horserace industry and the U.S. government, others in the industry assert that
litigation is unlikely at this point. Recent concerns were raised when an online
casino horse betting site asserted that it operated fully within U.S. laws. The
DoJ responded with a letter that confirmed that the DoJ views online casinos
horse betting as illegal, and also notes that the UIGEA was not intended as
legislation to address U.S. interstate horse betting.
So, considering that the DoJ is working steadily to obliterate online casino
sites in the U.S., some wonder why the DoJ has no plans to question the online
horse betting industry’s interpretation of federal laws. Most agree though that
a primary reason for the lack of litigation centers on the point that the DoJ
might not win a lawsuit against individuals or online casino horse batting
companies. Interpretation of the Interstate Horseracing Act and other federal
laws seem to favor the horse betting industry rather than the government’s
opinion.
