Courts Rule in Favor of Bwin
This has been a good month for the Gibraltar licensed Bwin Group. This online
casino gambling company has faced accusations from multiple countries that Bwin
is operating illegally, or counter to the country’s interests. Both Austria and
Germany announced rulings that supports Bwin’s right to operate and advertise in
both countries.
The Bwin Group primarily offers internet poker, betting, and online casinos
games to players. In Austria, the plaintiff, Omnia Communications Centers,
sought an injunction against Bwin’s right to operate online casinos within
Austria. But the Vienna Commercial Court instead ruled in favor of Bwin, citing
the rationale that Bwin and the plaintiff were not in direct competition in the
online casino industry.
In other great news for the online casino gambling company, a Munich court has
ruled that Bwin’s advertising activities are legal within Germany. Specifically,
the court ruled that Bwin and other online casino gambling companies are not
required to screen out Bavarian gamblers because it is a technically impossible
request.
The company was, needless to say, pleased with the outcomes of both court
hearings. Says Co-CEO of the online casino company Norbert Teufelberger, “We
welcome today’s decision by the court to reject this application for a
preliminary injunction.” And Co-CEO Manfred Bodner also had positive remarks
about the recent court decisions, “Legal action is not the right solution. We
are in favour of a constructive dialogue to regulate the gaming market not only
in the best interests of the consumer, but also in conformity with EU
legislation and taking into account the realities of the internet age.”
Bwin is one of the fastest growing companies in Europe, and with recent and
up-coming partnerships, many are predicting the company will dominate sports
betting, and online casino gambling in the coming years.
