Poker Debate has no End
It seems that every country is having concerns over the question of whether
online casino poker is a game of skill or chance. And though it seems like an
innocent enough question, the answer determines whether internet poker is
included in the ban that several countries have against online casinos gambling.
The Danish Courts though seem to have not aligned their judgment with the United
States’ decision that internet poker is in fact primarily a game of chance.
While U.S. courts have ruled that though skill is involved in online casino
poker, chance plays the most significant role as players do not have control
over the cards they are dealt. On the other hand, a Danish municipal court,
according to the Copenhagen Post, found the inverse. Though chance plays a part,
the game does require skill and therefore online casinos poker tournaments are
legal in Denmark.
This is great news for Frederik Hostrup, the President of the Danish Poker
Association. Hostrup was previously brought up on charges alleging he arranged
illegal online casino poker tournaments. Horesta, a hotel and restaurant trade
organization, filed the charges against Hostrup on behalf on land-based gambling
companies.
The debate about the legality of online casino poker gambling is still heated
though because the new ruling usurps last year’s decision by the Justice
Ministry’s Legal Affair’s Committee that internet poker was a part of the
country’s gambling ban.
The attorney for Hostrup, Henrik Hoffman, commented on why he thinks the courts
ruled in favor of internet poker. He notes, "You can win in poker based on being
clever enough to hide your strategy, even though you might have a fairly poor
hand." He also commented on the fact poker has become increasingly popular in
Denmark and online casino poker makes it more accessible for all Danes across
the country.
