Other Options for Rousso
Washington state is in for a battle with the lawyer Lee Rousso, a representative
for the Poker Player’s Alliance. Rousso is challenging Washington States current
laws that concern online casino and internet poker gambling in the state. And
though he openly acknowledges that “the state has won the first round in court,”
he also notes that he has many plans in store to ensure that the state cannot
dismiss the case out of hand as they blatantly attempting to shut down Rousso’s
case before it even goes to court. Online casinos are a hot issue in the U.S.
right now, and Rousso’s case comes right at a time when even Congress is unsure
of technical legalities and constitutional rights.
Rousso’s core issues with Washington State’s current legislation lies in the
fact that Washington is prosecuting online casino and betting players on
criminal charges – Class C felony charges to be exact. Basically, internet
gambling in Washington State could mean as much as five years in prison or a
$20,000 fine. His case challenges the states right to make U.S. players
criminally liable for online casinos gambling and questions the protectionist
laws in place that specifically ban online gambling in a state that has a
thriving land casino gambling industry.
But as Rousso noted, Washington State won the first round in court, and Rousso
is now in the process of appealing the courts decision. The case is in the
discovery phase and defense lawyers have requested information from Rousso that
may violate his Fifth Amendment right to not produce self incriminating
evidence. And though he has challenged the request, his first attempt failed.
Rousso though is not giving up on the online casinos case and notes that should
his continued appeals also fail that he has a secondary plan. Specifically, he
has “a substituted plaintiff lined up who could step into [his] shoes and pursue
the exact same Constitutional challenge to Washington's law." This is welcome
new in the online casino gambling industry, because most agree that Washington
State’s laws are both draconian and on the cusp of violating the U.S.
Constitution.
