Online Casino Monopolies Not Effective
The German government is adamant about protecting the state’s internet gambling
and betting monopolies despite requests and the threat of legal action from the
European Commission. Online casinos gambling is legal in the majority of the EU
countries, and because of the policies outlined in EU trade agreements, all
countries must allow the free flow of trade and commerce. Germany though has not
yet complied with request from the EU Commissioner, Charlie McCreevy, to pass
alternative legislation more in line with EU trade policies; Germany has even
gone so far as to propose a German State Treaty on Online Casinos gambling that
does not really address and fix any of the Commissioner’s requests.
The German State Treaty on Gambling would further secure a state gambling
monopoly over online casinos and betting sites, even though these policies are
in direct violation of EU trade treaties. And though Germany has been in talks
with the European Commission, it looks as though the issue may have to be taken
to the European Court of Justice before Germany complies with EU trade policies.
Recent news on the German State Treaty (which has not yet gone into effect)
indicates that a panel of online casino and internet experts has determined that
the German treaty is in fact impossible to enforce. Though many in the online
casinos industry have previously asserted that banning Web sites is not
effective, this latest panel is the first time that experts in the field have
met and analyzed a situation to the extent that they can make a decisive ruling
that parts of the treaty are in fact impossible.
Other countries have tried similar online casino legislation, and like the panel
predicts, these countries have all failed at the objective to keep out banned
Web sites, and to protect players from the ills associated with internet
gambling. Analysts in the industry agree that the only effective way to protect
players from underage and problem gambling is to license and regulate the
industry much like the UK’s online casino gambling policies.
