New Site Pushes Limits It was only a matter of time before companies in the United States found a way around U.S. gambling legislation that specifically targets online casino transactions. In this case, the Betcha.com site claims that a new betting system means that the site is not in violation of any of the U.S. gambling laws – so essentially all American players can access the site and use payment options that will clear with their U.S. based financial institutions. Well, the U.S. government has yet to stop the site (which really doesn’t even resemble an online casino), so in that regards, so far so good. For now, the site is already up and running, and the new betting system is this: the honor system.
This may sound a little odd, but the bettors are bound to pay-up based only on an honor system in place, which Betcha.com asserts puts the site’s betting firmly outside of the risk associated with traditional online casinos betting. The site really stresses that the honor system is means that Betcha is not liable for prosecution under current American Gambling Laws. So just how does this honor system work?
Basically, site members are able to bet on anything at all – as long as someone else wants to bet on it too. Then, after negotiating the bet, counter-offers, etc. players are only bound by their own honor to pay up. Now that doesn’t mean that everyone will Welch on their bets. The site has seen to that by a ranking system not unlike Ebay.com’s where members can choose who to bet with based on the member’s “Honour Rating.” This way the member base will effectively eliminate the problem bettors by no longer entering bets with them.
But the key element here is that players are not at risk when they make a bet, because they can choose not to honor the bet. For that reason, there is no risk involved in honor betting. According to the site: "Betcha bettors always retain the right to withdraw their bets and, for up to three days, not pay their losses. (Try that at an online casino.) Therefore, they are not "risking" anything. No "risk" means no "gamble."
The site gives an explanation that details the difference between traditional betting sites, online casinos, and the honor betting system, and why honor betting effectively navigates U.S. laws.
The site’s explanation about the legality of Betcha.com, not an online casino. "Yes. There are at least five reasons why the Betcha Platform falls outside legal prohibitions against gambling. While most of them are technical legalese, one isn't - it isn't "gambling." Although there are a few variations in syntax depending on the jurisdiction, the legal (and common sense) definition of "gambling," at bottom, requires that you (1) risk (2) something of value (3) on the result of a future event beyond your control. Betting that doesn't have all of these elements may be betting, but it isn't "gambling" and, therefore, isn't illegal."
