The EU Stands Firm on Laws

The European Commission is ready to come down hard on countries that are attempting to maneuver around standing laws that protect all of the countries in the European Union. Recently, Federal German States have announced that they are considering backing a German treaty that would essentially serve to protect the state from outside competition in the online casino gambling and betting industries. Though the EU has already addressed the proposed German treaty, it seems that the German states are continuing to pursue the treaty’s approval.

Online casinos are expanding quickly across many of the countries within the EU—and because of the nature of the EU, and the laws, none of the countries are allowed to pass what appears to be self-serving legislation. Both Germany and Austria were involved in legal cases against the online casino company Bwin – and both countries lost their cases because of free movement of capital laws among others.

In the past few weeks though the European Commission has continued to investigate the German ban on internet based sports bets and lotteries. Germany has shown an attitude markedly against online casinos and most form of internet gambling from foreign based companies. But the Commission has expressed real concerns that the German ban violates EU laws, and that the country may have instituted the ban as a way to monopolize the online casino gambling market within the country.

A German lottery specialist, Rainer Jacken, commented on the EUs position: “The EU has recognised that certain federal states are trying to exploit their legislative power in the face of super ordinate law, not – as is erroneously and repeatedly claimed – to protect people against gambling addiction, but to eliminate the competition and corner the economic advantages of monopolising the market. They won't succeed.”

Now that the EU is officially looking into the German ban and proposed treaty, the Germans now have a set time to present their arguments to the Commission before an official ruling is given.
